After being found guilty of contravening Section 3 (2) of Sexual Offences Act No3 of 2003, a 30-year-old man from Maputsoe who was an employee at one of the banks in Mohale’s Hoek, has been sentenced to 3 years without an option of a fine.

Evidence brought before the court indicated that in June 2017 Mahabe Khongoana intentionally and unlawfully committed a sexual act on a 19-year-old double orphan girl who was staying at an orphanage and had visited the bank to open an account, as she was a student at one of the Universities in the country.

The victim had previously informed the court that after being in Khongoana’s office for more than an hour she heard the latter talking on the phone with the Orphanage’s manager informing him that some documents which the victim had to open an account with were not there, after that he raped him again.

When passing her judgement, Magistrate Mofilikoane highlighted that she has taken into consideration the fact that Khongoana has already been in custody for a period of 6 to 7 years without sentence from the time the latter was convicted, hence why she reduced his sentencing.
