Leaders of Lesotho opposition parties met in Maseru on Wednesday this week, to emphasize their concern that the president of the Lesotho Court of Appeal Chief Justice Nthomeng Majara, has been removed from her position illegally.

The leader of Popular Frond for Democracy (PFD) Advocate Lekhetho Rakuoane, said the main concern of opposition parties which led to their dropping out of the negotiations temporarily on this matter, is that if the administration of courts of law is disrupted, there will end up being be no rule of law in Lesotho.

He pointed out that to stop this issue, they felt it was necessary for the Government of Lesotho and SADC to sit down for negotiations with them, and get this issue back on track.

Advocate Rakuoane indicated that while they were waiting for the intervention of SADC and the government, they found evidence of court documents which shocked them.

“One judge from Zimbabwe came to preside over the court case, against the provisions of the constitution that three judges should be appointed to preside over the court cases.”Honorable Rakuoane stated. He also said “It is true that there is what we call Interlocutory matter but what we feared about Chief Justice is now taking a different direction in that there is one judge who came here not under the request of the president of the Court of Appeal.”

He further said the issue of the two presidents of the Court of Appeal, which caused court cases on gazettes did not follow the right procedure.

He explained that the government itself took part in court decisions, in that while the courts were preparing to choose the judges who will preside on the case of Chief Justice, the government issued its own list of the judges.
