IEC ACCEPTS COURT RULING ON REINSTATEMENT OF POLITICAL PARTIES

Maseru, June 10 — The Independent Electoral Commission (IEC) has accepted a court ruling ordering the reinstatement of four political parties that were previously deregistered.

Speaking at a press conference in Maseru on Tuesday, IEC Chairperson Reverend Dr. John Maphephe said the commission respects the rule of law and will comply with the court's decision.

The court ruled that the Basutoland Democratic Congress (BDC), Bahlabani Ba Tokoloho Movement (BBTM), Basotho Democratic National Party (BDNP) and Lesotho Economic Freedom Fighters (LEFF) should be reinstated after they challenged the commission's decision to deregister them.

Dr. Maphephe explained that the deregistration was carried out in accordance with Section 27 of the Electoral Act of 2011, which gives the commission the authority to deregister political parties that fail to meet legal requirements.
He said the affected parties were dissatisfied with the commission's decision and exercised their right under Section 28 of the Act by taking the matter to court.

"The commission acted in good faith, although the court found otherwise. We have accepted the judgment and will study it carefully to determine the way forward," said Dr. Maphephe. He added that as an institution that respects the law, the IEC will implement the court's ruling.

Responding to allegations that the commission intended to reduce the number of political parties in the country, Dr. Maphephe dismissed the claims, saying the IEC only deregisters parties that fail to comply with legal and administrative requirements.

He stressed that the commission does not seek to limit the number of political parties but rather ensures that all registered parties comply with the standards set by law.

Meanwhile, Dr. Maphephe announced that the Director of Elections had resigned from office. He said the commission experienced challenges in filling the vacant position but has since appointed Ms. Lydia Macheli as Acting Director of Elections.

Dr. Maphephe further noted that whenever disagreements arise between the commission and its employees, stakeholders or political parties regarding the interpretation of the law, the courts play an important role in providing guidance and clarification.

He assured Basotho that despite the challenges facing the commission, the IEC remains committed to carrying out its responsibilities within the framework of the law.

The Chairperson added that the commission continues to operate with transparency, professionalism and accountability in the execution of its mandate.
