The Mahao Family has filed an urgent application before the High Court seeking re-instatement of Advocate Shaun Abrahams who was prosecuting a case in which some members of the army are charged with the murder of Maaparankoe Mahao.
The respondents in this matter comprise the Ministry of Law, Constitutional Affairs and Human Rights, Director of Public Prosecutions and the Attorney General.
The applicants are asking the court to order the respondents to immediately reinstate Adv. Abrahams as the foreign prosecutor for the case against the alleged Maaparankoe's killers. They are also asking the court to compel the respondents to pay the same lawyer and continue with an agreement they had with him.
They are seeking the court to give them a full detailed explanation concerning the withdrawal of foreign judges and prosecutors from a case in which the suspected killers of Maaparankoe are on trial.
In her affidavit, the wife of the late Maaparankoe, Mamphanya Mahao, has among others stated that the family had made a request before the Minister of Justice and were provided with foreign judges and prosecutors for the trial to ensure an impartial and fair legal process.
She indicated that Adv Abrahams has withdrawn from the case for alleged non-payment from the government while two foreign judges resigned because of non-compliance from the government. She however said the developments were not communicated to them as the family.
The deceased's wife pointed out that the absence of a competent and dedicated legal team jeopardises the integrity of the legal process as well as undermines the pursuit of justice for the aggrieved family. She emphasised that Adv. Abrahams was and is willing to see the matter to finality.
The application comes while some progress has been made in the criminal trial as over 25 witnesses have already testified.
