OCTOBER TO SEE PROGRESS IN CASES
OCTOBER TO SEE PROGRESS IN CASES
03 October 2023 | 09:55

At least five cases pending before the High Court of Lesotho and one before the Maseru Magistrate's Court which have attracted public interest for various reasons and some termed 'high profile cases' are this month expected to proceed. Some of these cases include three which are before a foreign judge Justice Charles Hungwe who was one of the judges appointed to deal with the high-profile cases.

The cases comprise one in which some members of the Lesotho Defence Force are charged with the murder of Maaparankoe Mahao who was allegedly killed on June 25 2015 at Ha Lekete in Mokema.  Another case is one in which some army members are accused of being responsible for the bombings which occurred at the homes of Maesiah Thabane the then Liabiloe Ramoholi at Moshoeshoe II and Former Commissioner of Police Khothatso Tsooana at Ha-Abia in 2014.

Another case which is before Justice Hungwe and has been set down for October 2023 is one in which four members of the Lesotho Mounted Police Service are charged with the murder of their colleague Police Constable Mokalekale Khetheng which allegedly occurred in 2016. It is however not yet clear whether the cases will proceed as a period of appointment for Justice Hungwe expired in August this year. Last week when the news about the contract of the judge emerged, it was not yet clear whether his contract will be renewed by the Government of Lesotho.

Justice Hungwe is the only foreign judge, out of three judges who were appointed, who was remaining after two judge Justices Kabelo Lebotse and Onkemetse Tshosa resigned. The cases which were before them were allocated to different local judges.

Another case expected to proceed before the High Court is one before Justice Polo Banyane. In this case some army members are accused of killing three men at Mafeteng in 2012. Another case is one before Justice Tseliso Mokoko whereby Qamo Matela is charged with the murder of his wife Mahlompho Matela, born Rethabile Mofolo. The case attracted public interest and activism against gender-based violence since the news of the deceased's death broke. The families of Matela and Mofolo even engaged in a legal battle over the burial of the deceased as the Mofolo family claimed a right to bury their daughter.

Another case expected to proceed this month is one before the Maseru Magistrate's Court whereby some army members are accused of attempted murder of Former Editor of the Lesotho Times and Sunday Express newspapers Lloyd Mutungamiri. The complainant in the matter was on July 09 2016 shot and injured at Ha- Thamae in Maseru.

The case is before Senior Resident Magistrate Peter Murenzi. It attracted several delays as the defence was against an accomplice witness Mahanyane Phusumane testifying in the case.
